With valuable insight gained from a career spanning over more than two decades, including former positions as Chief Legal Officer of a start-up biotechnology company, Senior Director of Intellectual Property at a United States-based generic pharmaceutical company, Assistant United States Attorney in the Western District of Wisconsin, and many years of patent litigation and prosecution experience in private practice, Wendy brings a rare combination of strengths to bear on clients’ IP matters.

As partner at Green, Griffith & Associates, Wendy focuses on patent litigation and counseling related to pharmaceutical, veterinary, biotech and chemical products.

A significant portion of Wendy’s practice includes advising clients regarding pre-initiation evaluation of product candidates and formulation and implementation of both patent challenge and defense strategies. She has handled all aspects of federal litigation and appeals, including serving as “first chair” in contentious, complex cases and delivering oral arguments in both the Seventh Circuit and Federal Circuit. Wendy also has experience handling trade secret cases and other complex intellectual property matters.

Wendy’s approach is informed by her in-house experience, having worked hand-in-hand to strategize with senior executives in business development, research and development and regulatory compliance. This experience allows Wendy to anticipate her clients’ needs and provide focused, efficient service.

In addition to her regular practice, Wendy also maintains an active pro bono practice in the Western District of Wisconsin. In 2015, she argued successfully on behalf of a pro bono client before the U.S. Supreme Court, setting a new Fourteenth Amendment objective standard in a prisoner civil rights case.

Before law school, Wendy worked as a researcher in in the Department of Ophthalmology at the University of Wisconsin-Madison, studying gene therapies in the treatment of retinoblastoma.

Lead counsel for veterinary health company in patent litigation involving porcine vaccine product in the U.S. District Court for the District of Minnesota. The litigation was successfully settled.

Co-lead counsel for a 503(B) sterile compounding company in trade secret litigation relating to vasopressin for injection in U.S. District Court of the District of New Jersey. The litigation was successfully settled.

Represented pharmaceutical companies in Hatch-Waxman litigations involving the following products:

Represented food additive company in patent litigation involving fiber product in the Western District of Wisconsin. The litigation was successfully settled.
